Darby vs. Allstate Security of Florida, Inc. & Federal Home Loan Mortgage Corporation

Negligent Security Case: Dade County Circuit Court. Plaintiff, Maria Darby, was shot three times in the face by her boyfriend, who subsequently committed suicide. She claimed psychological injuries, neurological injuries, paralysis and loss of feeling in her left arm/hand and one of the bullets remained lodged near her spinal cord threatening the potential for additional paralysis. Aggravated liability case where our security guard was changing the motor oil in his car at the time of the shooting, was not armed as required by contract (carried a holster with a sock in it) and was providing the Plaintiff’s boyfriend (who shot the Plaintiff) with information as to her activities in exchange for money. The Plaintiff initially demanded the $1,000,000 policy limits from both our insured, Allstate Security Company, and $1,000,000 from the premises owner. During the second day of trial, the case settled for $400,000 ($380,000 on behalf of our insured and $20,000 on behalf of the premises owner).
